Definition Standard of Evidence/Proof - the test required to meet certain levels of proof, such as beyond a reasonable doubt, clear and convincing, preponderance of evidence.
Application in Divorce Reasonable doubt applies in criminal actions; clear and convincing and preponderance of evidence in civil cases. Each establishes different thresholds by which the burden of proof is met. In each case, however, the burden of proof is on the party making the accusation, not the defendant.
