Definition Residency Requirement - the length of time a person must live in a state before becoming eligible to file for divorce there.

Application in Divorce Residency requirements vary from jurisdiction to jurisdiction, but are usually a minimum of six weeks to as long as a year.

If one or the other spouse is in the military, the divorce may be filed in the state where the military spouse is stationed.

At one time, Nevada became a divorce Mecca because it had the shortest residency requirement -- six weeks.

Alaska, South Dakota and Washington have no specific residency requirement.
