Definition Incorporation - in civil law, making one document part of another, e.g., the agreement becomes part of the decree in divorce.
Application in Divorce In divorced actions, separation and parenting agreements are normally incorporated into the divorce decree.

When separation and parenting agreements are incorporated into the divorce decree, they are court orders. Willful violation of their terms and conditions exposes a party to a charge of contempt of court.

Questions & Answers
Why are “merged” and “incorporated” different?
If you don’t comply with a merged contract, you can expect a suit for breach of contract. This will force compliance. This might not worry you initially, but if you don’t comply with a court order, you can end up in jail. Failure to comply with a court order is contempt of court.
Is a merged separation agreement better?
It may be, or it may not be, depending upon what you are trying to achieve. Agreements that are merged no longer have an independent life of their own. They cannot be sued upon as contracts; they may only be enforced as court orders. This may not be what you want. You may not want to give up the right to sue for breach of contract or "specific performance" (an order making someone comply to the terms of the contract). A merged separation agreement gives up this right.
