Application in Divorce One of the most important dates in a divorce is the DOS -- the date of permanent separation, which normally means the spouses are living apart with the intention of divorcing. The cutoff date establishes a date after which the spouses are individually responsible for their debts, and it is important in the division and distribution of assets.

The cutoff date draws a line in the sand relative to property, income and debts and means a physical separation must be joined with an independent intent by at least one of the parties to divorce. It must be communicated to the other spouse. A preponderance of evidence is satisfactory to prove this.
