Definition Bona Fide - honestly, openly, without deceit.
Application in Divorce The common use of this term in a divorce or dissolution of marriage is in regards to residency. In order to file for a divorce in a specific jurisdiction (court) either the filing spouse or the non-filing spouse must meet certain residency requirements. The requirements vary by state and range from 6 weeks to 1 year, depending on the applicable law and the circumstance. Inside the Petition or Complaint for divorce, it must be stated that the residency requirements have been met. This is done so by stating that either the filing or the non-filing spouse is a "bona fide" resident of the state and the county for a specific amount of time.
