Application in Divorce The common use of this term in a divorce or dissolution of marriage is in regards to residency. In order to file for a divorce in a specific jurisdiction (court) either the filing spouse or the non-filing spouse must meet certain residency requirements. The requirements vary by state and range from 6 weeks to 1 year, depending on the applicable law and the circumstance.
