A bill of sale can be drafted and signed by the spouses (or ex-spouses) to declare the sale of one of the marital assets to the other as set forth in the final divorce decree or judgment. In order for a bill of sale agreement (or contract) to be considered legal and enforceable, a sum of money must exchange hands, so oftentimes the sum of one dollar is used.
A bill of sale can also be used by two spouses who are separated and desire to divide their assets prior to filing for a divorce.
