Definition Appellant - the individual who brings the appeal in a divorce case.
Application in Divorce An appellant in a divorce case usually takes a road to no place because appeals, normally based on a trial court’s findings of fact and conclusions of law, are rarely successful (but always very expensive). Appeals courts review a lower court’s decision and judgment for substantive errors in the conclusions of the law but usually defer to the wisdom of the trial court.

In divorce actions, successful appeals are the exception. Appeals courts do not second guess a lower court’s findings of fact. States grant divorce judges substantial discretion in making judgment. Most often mistakes, if any, are considered harmless errors.
